This electronic contract is concluded in compliance with Spanish regulations and specifically under the legal regime imposed by Law 34/2002 on Services of the Information Society and Electronic Commerce (LSSICE) and by Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users (TRLDCU). The electronic contract is presented to the consumer in Spanish. These General Contracting Conditions may be saved and reproduced at any time by the user (hereinafter, the User or the Client, indistinctly) who makes a purchase through the options of their internet browser, and must be accepted before proceeding. to the payment of the products. 1. Select the products you want to purchase from those offered by baBaik on its website.
2. Select the product you want to buy and press the "Add to cart" button. If you wish, you can add as many products as you want to the shopping cart.
3. Once the selection of products has been completed, you will be able to access your cart in which a summary will appear identifying the selected item (s).
4. In the purchase process, you can identify yourself with the data of your User account or fill in the registration form if you are not yet a registered User. However, in cases where the purchase has an amount equal to or greater than three thousand euros (€ 3,000.00), the inclusion of tax data is required, in compliance with the regulations applicable to the billing process.
5. To finalize your purchase, you will have to select the shipping method you want, being able to choose between those offered by baBaik. In these cases, the buyer expressly declares to be the owner of the means of payment (without admitting the use of third-party means of payment, even with authorization).
6. Finally, you must choose the payment system for your order among those offered by baBaik on its website. Some means of payment such as PAYPAL or Aplazame are managed by the company that owns this means of payment, so baBaik declines any type of responsibility for problems arising from the use of these systems or platforms other than baBaik.

8. From this moment on, the process of preparation and delivery of the products sold by baBaik begins. baBaik will proceed to deliver the product to the address indicated in the purchase process. In the event that you choose the option of collection in a local store, you will be informed when the merchandise arrives at the established collection point, an SMS will be sent to inform you. If after fifteen (15) calendar days from the sending of the sms you have not picked up the merchandise, we will proceed to return the merchandise to our central warehouses and we will refund the amounts paid, at no cost to you. The process of refunding the amount will be carried out based on the procedure detailed in these General Conditions.
9. As a registered User, you can access your Account to view, print or download the invoices corresponding to the products sold by baBaik.
10. The User may only contract if they are of legal age and / or have legal capacity to link. Otherwise, the responsibility for placing orders by minors will be borne by the minor's parents or legal guardians.
baBaik has various payment methods to facilitate your purchases:
Payment by bank transfer is a simple payment method for making purchases over the Internet. The User can make said payment comfortably from his bank.
If you choose this payment option and once your order is finished, the necessary data to make the bank transfer will appear on the screen. We will also send you an email with these data. We will indicate the amount of the order, the concept that you must indicate in it and the account number of the entity you have selected. Remember that you must indicate the reference number of your order as the concept of payment to avoid errors in its management.

Credit / debit card
Payment by credit / debit card used in baBaik implies that your card information will be sent directly to our payment partner Banco de Sabadell, S.A., Avda. Óscar Esplá, 37, 03007 Alicante. By means of this payment method, baBaik never collects or manipulates any customer data regarding their card number. All data is processed directly by Banco de Sabadell, so that baBaik can always offer the greatest transparency and confidentiality in the transaction. The payment of your order is made directly with said entity, thus offering you maximum security.
The cards currently supported by the payment gateway are all those that bear the Visa and Mastercard distinctive, as well as those belonging to the 4B, Red 6000 and Servired networks.
The system also supports the CES (Secure Electronic Commerce) protocol. Therefore, your purchase is safer than if you use your card in a conventional store.
The User can make payments with his PayPal account.

In the event that during the purchase process you request deferred payment by financing the purchase, we inform you that, if you are a registered User, your identification and contact data will be transferred to the financial entity you have selected, with the so that you can formalize the contracting of financing. We inform you that baBaik does not participate in this process, does not manage any aspect of the granting of financing or regulate the terms in which it is processed and granted. baBaik is limited to putting in contact the Client and the financial entity selected by the latter, establishing from that moment the legal relationship between the Client and the financial entity.
TAXES, FEES AND FEES
Sale of products to the Spains Peninsula, Balearic Islands and European countries:
• The P.V.P (retail price) of the articles with shipping address to the Peninsula includes 21% of I.V.A.
Sale of products to Ceuta and Melilla:
Insofar as it is an import operation, the RRP of articles with a shipping address to Ceuta and Melilla does not include VAT. The price indicated on each item is its final price for shipments to Ceuta and Melilla.
Fees and duties: The User will be responsible for the settlement of all import expenses and taxes that are generated at the destination customs:
The DUA (Unique Administrative Document) is a document used to fulfill customs formalities such as export, import or transit. It serves as the basis for the subsequent income declaration and constitutes a support for information on the merchandise, its origin, value, taxes, etc. The User is responsible for the import DUA that will be charged in advance as part of the shipment of the order.
Import expenses: Shipments to Ceuta and Melilla are subject to the payment of import duties and taxes. The Tax on Production, Services and Import (I.P.S.I) has a surcharge on the price of each product of 3% in Ceuta and 5% in Melilla. The User is responsible for the I.S.P.I. tax.
Sale of products to the Canary Islands:
The price indicated on each item is the final price for shipments to the Canary Islands.

The SAD is a document used to fulfill customs formalities such as export, import or transit. It serves as the basis for the subsequent income declaration and constitutes a support for information on the merchandise, its origin, value, taxes, etc. The User is responsible for the import DUA that will be charged in advance as part of the shipment of the order.
Import expenses: Shipments to the Canary Islands are subject to the payment of import duties and taxes. The Canary Islands General Indirect Tax (I.G.I.C) has a tax burden on the price of the product of 3% or 7%, depending on the type of product. On the I.G.I.C, the Retail Surcharge (R.M) is settled with a surcharge rate of 10% of the I.G.I.C. Likewise, the Insular Merchandise Entry Tax (A.I.E.M), has a tax rate of 5%. The User is responsible for the A.I.E.M. fee.

No shipments will be made to PO boxes.
At baBaik we want our Clients to be always satisfied with our service. Therefore, we provide several methods to return a product that may not meet your needs.
Possible cases of return or withdrawal:
The product has a defect or has been damaged during transport:
To start the process, you must access to the following link and fill in the return form.
These products must be returned by the Customer in such a way that they are protected, including them inside a protective box or bag. baBaik will bear all the shipping costs for the delivery and return of the product.
When the product has been damaged during transport, we need you to notify us the same day you receive the merchandise.
Likewise, in order to expedite the return procedures, we would appreciate it if you could send us photographs of the damaged item and its packaging , in the part where appreciate the damage, as well as the barcode of the item and labeling of the damaged box .
Before opening the product, we recommend that you verify that the packaging matches the product you requested: (model, color, size, finish, etc.), and that you contact us immediately, in case of any anomaly . If you detect any anomaly before opening the product, please do not open the seal or its packaging.
In accordance with the provisions of Spanish legislation, the Customer has the Right of Withdrawal, by virtue of which he may return the product received if he finds that it does not meet his expectations.

Keep in mind that the exercise of this right of withdrawal will have to be carried out within a maximum period of fourteen (90) calendar days from its receipt. In order to exercise this right, the product must be in perfect condition and keep all the parts.
In case of withdrawal, baBaik will refund all payments received by the user, including delivery costs (with the exception of additional costs resulting from their choice of a delivery method other than the least expensive mode of ordinary delivery that we offer). The refund of the purchase amount will be made once the condition of the merchandise has been verified, through the same means of payment used by the Client and, in any case, within a maximum of 14 calendar days from the reliable receipt of the request for withdrawal, as long as baBaik manages the collection of the item. In the event that the Customer returns the item through a transport company of their choice, the period of fourteen (14) days will begin to run from the receipt of the item.
The return costs derived from the exercise of the right of withdrawal will be paid by the Client.
Remember that, in case of withdrawal in purchases made from Ceuta and / or Melilla, the return costs may suffer an increase compared to the shipping costs incurred in the delivery process, based on the rate established by the company of transport that receives the merchandise. The return costs also imply the payment by the consumer of the fees and duties accrued in said process. Keep in mind that these expenses can amount to a range of between 50.00- 60.00 euros.
baBaik is not responsible for any incident, loss, deterioration or any other direct or indirect damage that the products that are in the return package may suffer. In the event that the products do not arrive in perfect condition due to causes attributable to the Customer, baBaik reserves the right to pay a lower amount for your order based on the depreciation of the value of the product.
If you have not received the order yet
You can only cancel your order or make changes if your order is not already in the preparation phase. If it is already in the preparation phase, the delivery process is irreversible. In this case, you can reject the delivery of the same, and the Customer will be responsible for the transport costs derived from the return (a minimum of 9.99 euros VAT included).
Remember that, in case of withdrawal in purchases made from Ceuta and Melilla, the return costs may suffer an increase with respect to the shipping costs incurred in the delivery process, based on the rate established by the transport company you receive the merchandise. The return costs also imply the payment by the consumer of the fees and duties accrued in said process. These expenses can amount to a range of between 50.00- 60.00 euros.

All products offered on our website sold by baBaik are guaranteed against manufacturing defects for two (2) years from the date of delivery. The warranty does not include damage caused by misuse or habitual wear and tear.
In the event of a defective product, baBaik will proceed, as appropriate, to repair, replace, lower the price or terminate the contract, steps that will be free for the Customer. baBaik is liable for any lack of conformity that appears within two years from delivery. The Client must inform baBaik of the lack of conformity within two (2) months of becoming aware of it.

Unless proven otherwise, it will be understood that the products are in accordance with the contract provided they meet all the requirements expressed below:
a. They conform to the description made by the seller and have the qualities of the product that the seller has presented to the Client in the form of a sample or model.
Are suitable for the uses to which products of the same type are ordinarily intended.
c. Present the usual quality and performance of a product of the same type that the Customer can reasonably expect, taking into account the nature of the product.
